In an inexplicable case of mistaken identity, five Columbia School of Law students and their professor have today discovered that a Texas execution had put the wrong man to death. Carlos DeLuna, pictured below (we think), was mistaken for the actual killer, Carlos Hernandez, and put to death by lethal injection in 1989. The murder occurred in 1983 (giving everyone involved six years to mess up this royally).
DeLuna's budget attorney, apparently trying to help their client, even said that it was probable that Carlos Hernandez never existed and that DeLuna had completely made him up.
Up to the day he died in prison, Hernandez repeatedly admitted to murdering Wanda Lopez, professor James Liebman said.
"Unfortunately, the flaws in the system that wrongfully convicted and executed DeLuna continue to send innocent men to their death today," read a statement that accompanies the report.
