At least based on the precedent set by a case in Oregon in the US this week.
A 69-year-old man revealed to his 49-year-old partner (on the fourth date!) that he had herpes... after they had finished having unprotected sex, and as they say, the rest is history.
Well, sort of. It was revealed the woman offered the man a condom (and thought he put it on) before they got down to business. The pair met on the online dating site eHarmony, apparently a glowing advertisement for 69-year-old men with herpes looking for a new sex partner the world over.
